Provisional anticipatory bail is granted subject to bail bond, sureties, and verification of antecedents, with confirmation contingent on the number of prior cases.

Summary

The petitioner, Bhola Manjhi, sought anticipatory bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 30 litres of liquor from a pond not in his possession. He argued that the recovery was from land he does not own, that the police relied on a hostile chowkidar’s statement without proper investigation, and that he has three prior cases, two of which are also under the Excise Act. The State opposed the bail. The Court, after hearing both sides, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed verification of the petitioner’s criminal antecedents. If more than three prior cases are found, the bail will not be confirmed; if exactly three are found, the bail will be confirmed. The order is subject to compliance with Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the case
