Holding

The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s antecedent.

Summary

The petitioner, Pradeep Paswan, applied for anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 240 litres of liquor from a public graveyard. He contended that he was not arrested at the spot, the alleged liquor was not in his conscious possession, and the case was based solely on secret information without proper investigation. The State opposed the bail, arguing the seriousness of the offence and the petitioner’s prior seven cases under the Excise Act. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bond of Rs.35,000 with two sureties and directed verification of the petitioner’s criminal antecedent. It further held that if the verification shows more than seven prior cases, the bail would not be confirmed; if exactly seven, the bail would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 of the Cr.P.C. for an offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s prior criminal antecedent of seven cases affects the grant of anticipatory bail.
  • Whether reliance on secret information without a proper investigation justifies denial of bail.

recovered from his conscious possession and even the alleged

recovery is from a place which does not belong to the petitioner

and is accessible to public at large. It is further submitted that

petitioner came to be implicated based on the secret information

which is the easiest way to implicate someone. It is next

submitted that once an accused is implicated in a case relating to

excise the police start implicating mechanically either at the

instance of the Chawkidar, local person, confessional statement

or secret information without holding a proper investigation of

                                  9. It is made clear that thereafter the learned trial

court shall verify the criminal antecedent of the petitioner and if

it is found that petitioner has antecedent of more than seven

cases, it would be presumed that petitioner had concealed his
