Patna High Court

Sheshan Singh @ Sheshnath SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioners subject to a bail bond, sureties and conditions of monthly police station attendance.

Summary

The petitioners, a group of fourteen individuals from Mansi Police Station, sought anticipatory bail fearing arrest in connection with case No. 57 of 2026, which alleged offences under several sections of the Bihar Negotiable Instruments Act and Section 27 of the Arms Act, primarily for assaulting a victim. They contended that they were falsely implicated and that the prosecution’s case rested on a vague, omnibus allegation. The High Court, after hearing counsel, held that the nature of the allegations warranted the grant of anticipatory bail. Accordingly, the court ordered that the petitioners be released on bail upon furnishing a Rs 10,000 bond with two sureties, subject to compliance with Section 438(2) of the CrPC and Section 482 of the BNSS, and mandated monthly attendance at the police station. Any failure to appear would lead to cancellation of the bail bond.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the circumstances of the case
  • Whether the allegations against the petitioners constitute a general and omnibus charge justifying bail
  • Whether the conditions imposed under Section 438(2) CrPC and Section 482 BNSS are appropriate
