Holding
The Court held that the petitioner is entitled to pre‑arrest bail, subject to the stipulated conditions.
Summary
The petitioner, Benga @ Banga @ Ram Prasad Mahto, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 45 litres of country‑made Mahua liquor and 2,000 litres of fermented Mahua recovered from an open area near the river Ganga. The petitioner claimed innocence, arguing that the liquor was found in a public space accessible to anyone and that he had no connection with the recovery. The State opposed the grant of pre‑arrest bail. After considering the FIR and the fact that the recovery was from an open space, the Court held that the petitioner had made out a prima facie case for bail. Accordingly, the Court ordered his release on pre‑arrest bail subject to a bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the CrPC, directing the District Court to verify his criminal antecedents.
