Patna High Court

Suraj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail on furnishing the prescribed bond and sureties.

Summary

Suraj Kumar was arrested in connection with the alleged recovery of 120 litres of liquor from his residence and charged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner, who has eight prior cases under the Excise Act and has been in custody since 28‑03‑2026, argued that the liquor was not found in his conscious possession and that the house is a joint family property, making it uncertain that he had knowledge of the liquor. He also contended that the concept of deemed possession had been removed by the 2018 amendment to the Act. The State opposed the bail application. The Court, after considering the submissions and the period of custody, ordered the petitioner’s release on regular bail upon furnishing a bail bond of Rs.5,000 with two sureties of the same amount, subject to the trial court’s satisfaction.

Issues considered

  • Whether the petitioner is entitled to regular bail despite alleged possession of liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the doctrine of deemed possession applies post‑2018 amendment to the Excise Act.
