Holding
The Court ordered provisional anticipatory bail subject to verification of antecedents, with bond and sureties, and conditional confirmation.
Summary
The petitioner, Chandan Mahto, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, alleging that the alleged seizure of liquor and mahua occurred at a location not under his control and that he had no possession of the contraband. He highlighted his two prior cases under the Excise Act and argued that the investigation was mechanically driven without proper inquiry. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and directed verification of the petitioner’s criminal antecedents. If more than two prior cases are found, the bail would not be confirmed; if only two, the bail would be confirmed. The order was made under Section 482(2) of the B.N.S.S.
