BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to the conditions prescribed under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Summary

The petitioner, Suresh Ray, sought anticipatory bail fearing arrest in a case (PS No. 665 of 2025) under the Bihar Prohibition and Excise Act for alleged possession of 260 litres of liquor. The prosecution alleged the liquor was recovered from a public area, while the petitioner claimed he had no knowledge or involvement and was falsely implicated. The petitioner also highlighted the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail. The court, after considering the prima facie lack of case and procedural lapses, granted anticipatory bail on the condition of a Rs.15,000 bond, two sureties, and compliance with Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
