Patna High Court

Chandan ChaudharyversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court granted provisional anticipatory bail subject to verification of antecedents and compliance with bail conditions.

Summary

The petitioners, three members of the Chaudhary family, feared arrest in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act concerning the alleged recovery of 100 litres of liquor from a mango orchard. They contended that no liquor was found on them, the alleged recovery site did not belong to them, and the case relied solely on a confessional statement of another accused in police custody, which they argued lacked evidentiary value. The petitioners also disclosed prior excise cases – three for petitioners 1 and 3 and two for petitioner 2 – and submitted that these antecedents should be considered. The State opposed the prayer for anticipatory bail. The Patna High Court, after hearing both sides, granted provisional anticipatory bail conditioned on furnishing bail bonds of Rs 15,000 with two sureties each and directed verification of the criminal antecedents; if the antecedents exceed the stated numbers, the bail would not be confirmed, an order made under Section 482(2) of the Code of Criminal Procedure.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act
  • Whether prior criminal antecedents affect the grant of anticipatory bail
  • Whether a confessional statement of an accused in police custody can be the sole basis for arrest

such nothing was recovered from their conscious possession and

even alleged recovery is from a place which does not belong to

the petitioner and they came to be implicated based on

custody which does not have any evidentiary value. It is also

submitted that once an accused is implicated in a case relating to

petitioners in that event the provisional anticipatory bail order

                       shall be confirmed forthwith.
