Provisional anticipatory bail was granted subject to bail bond, sureties, and verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Vijay Mukhiya, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, alleging that liquor was recovered from a motorcycle and a scooty that he did not own. He argued that no liquor was found in his immediate possession and that he was implicated by a local informant without proper investigation. The State opposed his request for anticipatory bail. The High Court, considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.5,000 with two sureties and that the trial court verify his criminal antecedents. If more than one prior case is found, the bail would not be confirmed; if only one prior case is found, the bail would be confirmed. The order was made under Section 482(2) of the Criminal Procedure Code.
