Patna High Court

Durgesh KamatversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted pre‑arrest bail to the petitioner.

Summary

Durgesh Kamat applied for pre‑arrest bail after a police case (Nagar P.S. Case No. 167 of 2023) alleged that 5.7 litres of illicit liquor were recovered from a vehicle registered in his name. The petitioner was not named in the FIR and claimed he had no knowledge of the vehicle being used for liquor transport and possessed a clean criminal record. The State opposed the bail, arguing the vehicle registration linked the petitioner to the offence under Section 30(a) of the Bihar Prohibition and Excise Act. The court noted that the petitioner’s implication was solely on the basis of the registration certificate, he had no prior convictions, and the State had not effectively implemented its liquor policy. Consequently, the court granted pre‑arrest bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to appear before the District Court within four weeks, subject to Section 482(2) of the BNSS, and ordered verification of his antecedents.

Issues considered

  • Whether pre‑arrest bail can be granted when the accused is not named in the FIR but is implicated solely through vehicle registration.
  • Whether the nature of the offence under Section 30(a) of the Bihar Prohibition and Excise Act warrants denial of pre‑arrest bail.
  • Whether Section 482(2) of the BNSS can be invoked to condition the grant of pre‑arrest bail.
