Patna High Court

Sanjeev Chaupal @ Rajeev ChaupalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Since the informant’s statement does not incriminate the petitioners, bail is granted subject to conditions under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.

Summary

The petitioners, accused in a case of alleged child trafficking under Sections 140(2) and 143(4) of the Bharatiya Nyaya Sanhita, 2023, applied for bail in two related criminal miscellaneous applications arising from the same police case. They contended that the mother of the child, who is the informant, did not make any incriminating statement against them and that they were falsely implicated. The State opposed bail, arguing the seriousness of the offence and noting a prior criminal antecedent for some petitioners. The Court observed that the informant’s statement did not allege any involvement by the petitioners and therefore found no substantive ground to deny bail. Consequently, the Court ordered bail on a bond of Rs 10,000 with two sureties and imposed conditions under Section 482(2) of the BNSS, including regular appearance before the trial court and non‑interference with witnesses.

Issues considered

  • Whether bail should be granted to the accused under Sections 140(2) and 143(4) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the informant’s statement implicates the petitioners.
  • Whether the petitioners’ prior criminal antecedent affects the grant of bail.
