Patna High Court

Hazim SulaimanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to the stipulated conditions.

Summary

Petitioner Hazim Sulaiman feared arrest in a dowry‑related case (PS Gaunaha Case No. 109 of 2024) involving offences under Sections 341, 323, 379, 420, 498(A), 313, 34 of the IPC and Section 3 of the Dowry Prohibition Act. The prosecution alleged he assaulted the victim to demand dowry. The petitioner claimed innocence and asserted that the dispute had been settled, with a payment of Rs. 10 lakh to the informant, a fact corroborated by the informant’s counsel. The court, noting the settlement, allowed the bail application. It ordered that if the petitioner is arrested or surrenders within eight weeks, he shall be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to the conditions of Section 438(2) of the CrPC and Section 482 of the CrPC.

Issues considered

  • Whether the settlement between the parties warrants the grant of bail to the petitioner.
  • Whether the petitioner is entitled to bail under Section 438(2) of the Code of Criminal Procedure, 1973 despite the pending charges.
