The Court inclined to grant bail to the petitioner.
Summary
Petitioner Prabhakar Kumar Paswan was arrested in connection with the recovery of 405 litres of Nepali liquor near his house, alleged to be offences under Sections 274, 275 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence, stating no incriminating material was found in his possession and that the recovery was from an open public area, with his name disclosed only through secret information. He had previously been granted anticipatory bail but remained in custody due to a prior criminal antecedent and alleged non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed the bail application. Considering the facts, the period of custody, and the procedural lapse, the Court inclined to grant bail, ordering the petitioner to furnish a bail bond of Rs.15,000 with two sureties of equal amount.
Issues considered
- Whether bail should be granted to the petitioner in offences under the Bharatiya Nyaya Sanhita, 2023 and the Bihar Prohibition and Excise Act despite a prior criminal antecedent.
- Whether the procedural requirement of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been complied with.
