Himanshu KumarversusThe State of Bihar

Holding

The Court granted provisional anticipatory bail, subject to verification of the petitioner’s antecedents.

Summary

The petitioner, Himanshu Kumar, sought anticipatory bail in a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018, where 35 litres of liquor were allegedly recovered from a motorcycle. He argued that he had no prior criminal record, was not the owner of the vehicle, and the only link to the offence was a confessional statement made by another person in police custody, which he claimed lacked evidentiary value. The State opposed the bail. The Court, after considering the clean antecedent claim and the weak evidential basis, granted provisional anticipatory bail subject to a bail bond of Rs.500 and two sureties, and directed the trial court to verify his antecedents. If any prior case is found, the bail will not be confirmed; otherwise, it will be confirmed immediately.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the excise offence.
  • Whether the confessional statement of a co-accused can form a basis for arrest.
  • Whether the petitioner’s lack of possession and clean antecedent justify bail.
