Anticipatory bail is granted to the petitioner subject to bond and surety conditions.
Summary
Petitioner Ravi Prakash Jha applied for anticipatory bail after being implicated in a mob assault and robbery case dated 10 March 2025, where the FIR alleged offences under several sections of the Bharatiya Nyaya Sanhita and the Arms Act. The prosecution alleged that the accused, including the petitioner, used iron rods, pistols, and physical force to assault an informant and snatch valuables. The petitioner contended he was merely a member of the crowd, with no specific overt act attributed to him, and highlighted his clean antecedent. The State opposed the bail, arguing the seriousness of the charges. Considering the lack of specific incriminating acts against the petitioner, his clean record, and the nature of the allegations, the court granted anticipatory bail subject to a bond of Rs. 10,000 and two sureties, with conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Issues considered
- Whether anticipatory bail can be granted to the petitioner despite the serious charges under the Bharatiya Nyaya Sanhita and the Arms Act.
- Whether the petitioner’s alleged participation as a mere member of the mob, without specific overt acts, warrants bail.
- Whether the petitioner’s clean antecedent and the nature of the allegations justify the discharge of the anticipatory bail application.
