Patna High Court

Sikindar Sah @ Sikindar Kumar @ Sakindra SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, subject to specified conditions.

Summary

The petitioner, Sikindar Sah, was arrested while riding a blue motorcycle that was alleged to be stolen, and he failed to produce the vehicle's documents. The prosecution alleged that the vehicle's number plate and tank were tampered to conceal its identity, and the owner had lodged an FIR for theft. The petitioner claimed innocence, asserted no criminal antecedents, and argued that he was falsely implicated due to personal enmity, seeking regular bail under Sections 338, 339, 340(2), 317(5) and 336(3) of the Bhartiya Nyaya Sanhita, 2023. The State opposed bail, but the court, after considering the circumstances and lack of specific incriminating evidence, ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, subject to conditions of family surety, cooperation with trial, and non‑tampering with evidence. The bail was granted with the provision that the prosecution may move for cancellation if the petitioner interferes with evidence or witnesses.

Issues considered

  • Whether bail should be granted to the accused in a case involving alleged theft of a motor vehicle and offences under the Bhartiya Nyaya Sanhita, 2023.
  • Whether the prosecution has established sufficient grounds to deny bail on the basis of risk of evidence tampering or flight.
  • Whether the petitioner’s claim of false implication and lack of antecedents warrants regular bail.
