The court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedents and compliance with the conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Dharmendra Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 110 litres of liquor recovered from a dalan on his premises. He argued he had a clean antecedent, the liquor was not in his immediate possession, and the informants (local person and chowkidar) failed to report the matter earlier, casting doubt on the prosecution's case. The State opposed the bail. The court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties and directed the trial court to verify the petitioner’s antecedents. If any prior case is found, the bail would be presumed concealed and not confirmed; otherwise, it would be confirmed. The order was made under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act
  • Whether the circumstances, including lack of immediate possession and clean antecedent, justify granting anticipatory bail

                   Bihar Prohibition and Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

recovery of 110 litres of liquor from Dalan of petitioner. It is

implicated and he came to be implicated at the instance of local

person and chowkidar but then it is submitted that if local

person and chowkidar were aware of the involvement of the
