The Court ordered provisional anticipatory bail for the petitioner, subject to bail bonds and verification of his antecedent.
Summary
The petitioner, Harihar Mandal, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, alleging that liquor was recovered from premises adjacent to his house and not from his possession. He argued he has a clean antecedent and that the complainant, a watchman (chawkidar) with whom he has a hostile relationship, failed to inform police earlier, casting doubt on the prosecution's case. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S., directing the trial court to verify the petitioner’s antecedent before confirming the bail. If any prior case is found, the bail will not be confirmed; otherwise, it will be confirmed immediately. The order reflects the Court’s discretion to balance the petitioner’s rights against the seriousness of the alleged offence.
Issues considered
- Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
- Whether the petitioner’s lack of possession of the alleged liquor and his clean antecedent justify the grant of anticipatory bail.
- Whether the conditions prescribed under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. are applicable.
