Md. JabbarversusThe State of Bihar

The Court ordered provisional anticipatory bail with conditions, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Md. Jabbar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 108 litres of liquor were recovered from a motorcycle. He contended that he was not arrested on the spot, had no conscious possession of the liquor, and was not the owner of the vehicle, asserting that the informant’s name was omitted from the FIR. The State opposed the bail, arguing the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent. It further stipulated that if more than three prior cases are found, the bail would not be confirmed; if only three, the bail would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s alleged lack of possession and ownership of the seized vehicle precludes arrest.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
