Dinesh MehtaversusThe State of Bihar

Holding

The provisional bail granted to the petitioner on 27 January 2026 is confirmed.

Summary

Dinesh Mehta was arrested on 18 November 2025 in connection with FIR No. 127 of 2025 alleging offences under several sections of the Bhartiya Nyaya Sanhita, 2023. He contended that he was falsely implicated and that the same allegations were the subject of another case (Case No. 1068 of 2026) before the D.C.L.R. Court. The court noted that co‑accused Mahesh Mehta and Khagesh Mehta had been granted anticipatory bail by a coordinate bench in Cr. Misc. No. 5924 of 2026, and that the petitioner had already been given provisional bail on 27 January 2026, which had been periodically extended. The bench confirmed the provisional bail, thereby granting the petitioner full bail. Consequently, the bail petition was disposed of.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious offences alleged under the Bhartiya Nyaya Sanhita.
  • Whether the provisional bail previously granted should be confirmed.
  • Whether the claim of false implication affects the bail decision.
