Holding
The Court held that bail should be granted to the petitioner.
Summary
The petitioner, Bablu Kumar, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 60 litres of liquor in a motorcycle he owned. He contended that he was falsely implicated, had no knowledge of the liquor, and that no incriminating article was found in his personal possession. The petitioner also highlighted the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail. Considering the facts, the period of custody since 13‑10‑2025, and the petitioner’s clean record, the Court inclined to grant bail, imposing a bond of Rs.15,000 with two sureties and conditions regarding family surety and regular appearance. The bail was consequently ordered.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of alleged false implication and lack of personal possession of the contraband.
- Whether the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, warrants denial of bail.
