Patna High Court

Navin Kumar RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

Navin Kumar Ram, a 19‑year‑old, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 90 litres of Nepali liquor in two plastic sacks on a TVS Apache motorcycle. The petitioner contended that he was merely a passer‑by, had no knowledge of the liquor, and was framed due to village politics, emphasizing the lack of any incriminating article found in his possession and the absence of independent witnesses. The State opposed the bail, relying on the FIR based on an informant’s report. The High Court examined the sufficiency of the evidence and the petitioner’s right to liberty, noting the weak evidentiary basis. Consequently, the Court granted regular bail on a bond of Rs.10,000 with two sureties, directing the petitioner’s release pending further trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the FIR being based solely on an informant’s report.
  • Whether the absence of independent witnesses and lack of seized articles in the petitioner’s possession justify granting bail.
