Patna High Court

Pappu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond and specific conditions, as the accusation rests solely on a co-accused’s confession and no material evidence was recovered.

Summary

The petitioner, Pappu Kumar, was implicated in a loot case (FIR No. 169 of 2025) under Section 310(2) of the BNS based solely on the confessional statement of a co-accused, Randhir Kumar, with no material recovered from his possession. He pleaded that he has a clean antecedent and that the allegations are fabricated. The State opposed his bail, but the court noted the lack of any direct evidence against him. Considering his clean record and the absence of seized items, the court ordered his release on bail, subject to a bond of Rs.10,000 with two sureties and several conditions. The bail was granted under Section 438(2) of the Code of Criminal Procedure and Section 482(2) of the BNSS, 2023, with provisions for cancellation if he fails to cooperate, tampers with evidence, or conceals his antecedent.

Issues considered

  • Whether bail should be granted to the petitioner when the only basis of accusation is a co-accused's confessional statement and no material evidence is found.
  • Whether the petitioner’s clean antecedent and lack of recovered property justify bail under Section 438(2) CrPC and Section 482(2) BNSS.
