Patna High Court

Ajay DasversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner.

Summary

The petitioner, Ajay Das, was arrested as the driver of a pickup van from which 864 litres of liquor were seized, leading to charges under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act. He contended that he was falsely implicated, that no incriminating article was found in his possession, and that he had no knowledge of the contraband as he was not the vehicle's owner. The petitioner also highlighted his clean criminal record and the alleged non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail, but the Court, after considering the custody period and the circumstances, decided to grant bail. The bail was conditioned on a bond of Rs.15,000 with two sureties, one of whom must be a close family member, and on the petitioner’s regular appearance before the trial court.

Issues considered

  • Whether bail should be granted to the accused driver in a case under the Bihar Prohibition and Excise Act considering the facts and the non‑application of Section 103 of the Bharatiya Nagarika Suraksha Sanhita
