Patna High Court

Sanjay Kumar @ SanjayversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioners.

Summary

The petitioners, Sanjay Kumar and Md Shafkat Alam, were arrested in connection with a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act for allegedly transporting 160.640 litres of liquor. They contended that they were falsely implicated, that the liquor was not in their conscious possession, and that they were merely a driver and a passenger, not owners of the vehicle. The State opposed bail, while the petitioners highlighted the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, and the absence of any incriminating article on them. The court examined the facts, the custody period, and the petitioners' criminal records, and decided to grant bail. Each petitioner was ordered to furnish a bail bond of Rs. 15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, precludes the grant of bail.
  • Whether the petitioners' lack of ownership or conscious possession of the liquor vehicle affects their eligibility for bail.
