Patna High Court

Sanjeet Kumar Giri @ Sanjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on condition of a bond and sureties, with the trial court empowered to cancel the bail if the petitioner attempts to delay the trial.

Summary

The petitioner, Sanjeet Kumar Giri, was charged under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act in a case registered as PS Masaurhi Case No. 606 of 2021. An earlier application for regular bail (Cr. Misc. No. 28538 of 2026) was rejected, with the court directing the petitioner to renew his prayer after charge framing. Charges were subsequently framed on 21-5-2026, and the petitioner again sought bail. The State opposed the bail, citing the seriousness of the offences under the NDPS Act. The Court, after considering the submissions, granted bail on condition of a Rs. 25,000 bond and two sureties of equal amount, subject to cancellation if the petitioner attempts to delay the trial. The order also directed that the trial court may cancel the bail if such conduct is observed.

Issues considered

  • Whether bail can be granted to an accused charged under Sections 20 and 22 of the NDPS Act after charge framing
