Provisional anticipatory bail was granted subject to verification of the petitioner’s antecedents and compliance with bail bond conditions.

Summary

The petitioner, Raju Das, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of liquor recovered from a joint family house. He contended that he had a clean antecedent, that the liquor was not found in his conscious possession, and that the prosecution’s case relied on a confessional statement made by another accused while in police custody, which he argued lacked evidentiary value. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish bail bonds and two sureties, and that the trial court verify his criminal antecedents. The order stipulated that if any antecedent is discovered, the bail would be cancelled; otherwise, the provisional bail would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether a confessional statement made by a co-accused in police custody can be the basis for granting anticipatory bail.
  • Whether the concept of deemed possession under the amended Excise Act affects the petitioner’s liability.
