Patna High Court

Puja Rani @ ChandanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to a bond of Rs.10,000 with two sureties and conditions under section 482(2) of the BNSS, 2023.

Summary

The petitioners, three transgender individuals, were accused in an FIR for assaulting an informant and others, resulting in minor injuries to four persons, and faced charges under multiple IPC sections including 447, 341, 323, 307, 427, 448, 380, 504, 506 and 34. They filed a bail petition fearing arrest, asserting that the allegations were general, the injuries were simple, and they have a clean antecedent. The State opposed the bail. The Court considered the nature of the injuries, the petitioners' clean record, and other circumstances, and decided to grant bail on the condition of a Rs.10,000 bond with two sureties, subject to conditions under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The bail order was directed to be complied with by the Judicial Magistrate of Danapur. The decision reflects a balance between the seriousness of the charges and the petitioners' personal circumstances.
