Holding
The court held that bail should be granted to the petitioner.
Summary
The petitioner, Ravi Ranjan Kumar, was arrested after 60 litres of liquor were recovered from his scooter in a case under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was falsely implicated, asserting that he was only the owner of the vehicle and had no knowledge of the contraband. The prosecution opposed bail, while the petitioner’s counsel highlighted the absence of any incriminating article in his possession and the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The court noted the petitioner’s two prior criminal antecedents and his custody since 19‑12‑2025. Considering these facts, the court granted bail, directing the petitioner to furnish a bail bond of Rs.15,000 with two sureties of equal amount. The order was pronounced by Justice Rudra Prakash Mishra.
Issues considered
