The Court granted bail to the petitioner, subject to a bond and conditions under Section 482(2) of the B.N.S.
Summary
Vishal Kumar petitioned the Patna High Court for bail in a criminal case (PS Case No. 371 of 2025) registered under multiple offences of the Bharatiya Nagarik Suraksha Sanhita (B.N.S.). The FIR alleged that he assaulted the informant with a "farsa" causing a simple injury. The petitioner asserted a clean antecedent and argued that the injury was minor. The State opposed the bail application. Considering the nature of the injury, the petitioner’s clean record, and the possibility of surrender within eight weeks, the Court granted bail on a bond of Rs.10,000 with two sureties, subject to the conditions of Section 482(2) of the B.N.S., 2023.
Issues considered
- Whether bail should be granted to the petitioner in view of the offences alleged under the B.N.S. and the circumstances of the case.
