The Court conditionally granted provisional anticipatory bail to the petitioner, subject to bail bond, sureties, and verification of his criminal antecedent.

Summary

Petitioner Ratnesh Singh sought anticipatory bail fearing arrest in a case under Sections 30(a) and 36 of the Bihar Excise Act, alleging recovery of 1,364.250 litres of liquor from a truck. He argued that he was not caught in possession, was not the owner of the vehicle, and was implicated solely on a confessional statement of another accused, which he claimed lacked evidentiary value. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition of furnishing a bail bond of Rs.15,000 with two sureties and compliance with Section 482(2) of the CrPC, subject to verification of the petitioner’s criminal antecedent. If the trial court finds more than three prior cases, the bail will not be confirmed; otherwise it will be confirmed. The petitioner was also directed to deposit Rs.2,500 with the Advocates’ Association within two weeks.

Issues considered

  • Whether anticipatory bail should be granted in a case under the Bihar Excise Act where the petitioner is implicated solely on a confessional statement of another accused.
  • Whether the petitioner’s prior criminal antecedent of three cases affects the grant of anticipatory bail.
