Holding

The court granted provisional anticipatory bail subject to conditions and pending verification of the petitioner’s criminal antecedent.

Summary

Rampukar Singh applied for anticipatory bail fearing arrest in a case under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of liquor and spirits from a location not owned by him and seizure of two motorcycles. He contended that no contraband was found in his possession and that the case was based on secret information without proper investigation. The State opposed the bail. The High Court, considering the petitioner's submissions, granted provisional anticipatory bail subject to a Rs.5,000 bail bond, two sureties of equal amount, and compliance with conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. The court directed the trial court to verify the petitioner's criminal antecedent, stating that if more than one prior case is found, the bail will not be confirmed; if only one prior case is found, the bail will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the circumstances of the case.
  • Whether the petitioner’s alleged antecedent affects the confirmation of anticipatory bail.

Rabindra Kumar, learned A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Sections 30(a) and

30(c) of the Bihar Prohibition and Excise (Amendment) Act,

                   2022.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of one case under the Excise Act and

allegation is of recovery of 138 litres of liquor along with 350

                                4. Learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

and is not the owner of any of the seized vehicles and came to

be implicated based on the secret information which is the

easiest way to implicate someone. It is further submitted that

once an accused is implicated in a case relating to excise the

police start implicating mechanically either at the instance of the

Chawkidar, local person, confessional statement or secret

information without holding a proper investigation of the case.

                       5. Learned A.P.P. for the State opposes the prayer for

Section 438(2) of the Cr.P.C./482(2) of the B.N.S.S.

                       7. However, it is made clear that thereafter the learned

Trial Court shall verify the criminal antecedent of the petitioner

case, it would be presumed that petitioner had concealed his

antecedent before this Court at para 3 of the anticipatory bail
