Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties and verification of antecedent.

Summary

Bandhan Kumari applied for anticipatory bail fearing arrest in a case registered under Sections 190, 132, 121(1) and 263 of the Bihar Narcotic Substances Act and Sections 30(a) and 45 of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 50 litres of liquor from her brother Gautam's house. The petitioner, a woman with a clean antecedent, argued that she was not arrested on the spot, no liquor was found in her possession, and the only link to her was her brother's confessional statement made while in police custody, which she contended lacks evidentiary value. The State opposed the anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs.500 and two sureties, invoking Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S., and conditioned the order on verification of the petitioner’s antecedent by the trial court.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. given the nature of the allegations.
  • Whether the brother's confessional statement made in police custody can be the basis for implicating the petitioner.
  • Whether the absence of possession and clean antecedent justify granting anticipatory bail.

petitioner was not arrested from the spot, as such, nothing was

namely, Gautam in police custody which does not have any

evidentiary value in the eye of law.
