Patna High Court

Satyendra RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Satyendra Rai, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 125 litres of liquor recovered from a public place. He contended that he was falsely implicated, no liquor was found in his personal possession, and the recovery was from an open area accessible to all. The State opposed bail, citing the seriousness of the offence and the petitioner’s six prior criminal antecedents. The Court noted the lack of direct incriminating evidence against the petitioner, the duration of his custody since 10‑12‑2025, and the non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. Considering these factors, the Court granted bail on the condition of a Rs.15,000 bond with two sureties, one of whom must be a close family member, and mandatory attendance at all trial dates.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in the absence of direct incriminating material.
  • Whether the petitioner’s prior criminal antecedents and the non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, preclude bail.
