Holding

The bail application was dismissed.

Summary

Petitioner Prabin Kumar was arrested on 12‑12‑2025 in connection with a case registered under Sections 126(2), 109(1), 308(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act, alleging extortion and refusal to pay for goods taken on credit. The petitioner claimed innocence and sought regular bail, contending that he had been falsely implicated. The State opposed the bail, highlighting the seriousness of the offences and the petitioner’s three prior criminal antecedents. Justice Sandeep Kumar, after considering the nature of the allegations and the antecedents, was not inclined to grant bail. Consequently, the bail application was dismissed, with the court noting that its observations were limited to the bail application and did not prejudice the trial’s merits.
