Patna High Court

Madho Yadav @ Vikash YadavversusThe State of Bihar

Decided

DISPOSED

Holding

The court conditionally granted provisional anticipatory bail subject to verification of the petitioner’s criminal antecedent.

Summary

Madho Yadav sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act, where 46 litres of liquor were recovered from a motorcycle. He argued he was not in possession of the vehicle and was implicated solely on a confessional statement of another accused, which he claimed lacked evidentiary value. The State opposed the bail. The court granted provisional anticipatory bail on condition of a Rs.5,000 bond with two sureties and ordered verification of the petitioner’s criminal antecedents. If more than one prior case is found, the bail will not be confirmed; if only one prior case, the provisional bail will be confirmed. The petitioner was also directed to deposit Rs.2,500 with the Advocates’ Association.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act.
  • Whether a confessional statement of another accused can form the basis for implicating the petitioner.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
