Rajesh SahaniversusThe State of Bihar

Holding

The Court provisionally granted anticipatory bail subject to verification of the petitioner’s antecedents and compliance with bail bond conditions.

Summary

Petitioner Rajesh Sahani sought anticipatory bail in a case registered under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, alleging that the alleged seizure of 90 litres of liquor and a mobile phone occurred at a location not belonging to him and that he had no conscious possession. The petitioner, described as having a clean antecedent, claimed the complaint was motivated by an inimical chowkidar. The State opposed the bail. The Court granted provisional anticipatory bail, subject to a bail bond of Rs.500 with two sureties and a condition that the trial court verify the petitioner’s antecedents within six weeks. If any prior case is found, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner under the circumstances described?
  • Whether the petitioner’s alleged lack of conscious possession and clean antecedent justify provisional anticipatory bail?
