The Court ordered provisional anticipatory bail, subject to verification of antecedents, with conditions for bond and sureties.

Summary

The petitioner, Mithilesh Manjhi, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2018, where liquor was allegedly recovered from a bush near his house and a nearby godown. He argued that no liquor was found in his possession, the recovery site did not belong to him, and the informant’s name was omitted from the FIR, with the co-accused not naming him. The State opposed the bail. The Court granted provisional anticipatory bail conditioned on a Rs.15,000 bond with two sureties and directed the trial court to verify his criminal antecedents, stating that if more than three prior cases are found, the bail would not be confirmed. If only three prior cases are verified, the bail would be confirmed immediately. The order was made under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the B.N.S.S. in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2018
  • Whether the petitioner’s criminal antecedents affect the confirmation of anticipatory bail
