Patna High Court

Ganesh Chaudhari @ Ganesh ChaudhriversusThe State of Bihar

Decided

DISPOSED

Holding

The court granted provisional anticipatory bail subject to conditions and verification of antecedents.

Summary

Ganesh Chaudhari was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 for allegedly possessing 30 litres of liquor recovered from his house, which is a joint family property. He argued that the liquor was not in his conscious possession, that the concept of deemed possession had been removed by the 2018 amendment, and that the informant (chowkidar) was hostile towards him. The petitioner sought anticipatory bail, contending that the FIR was filed on the informant’s malicious suggestion. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and directed verification of the petitioner’s criminal antecedents, with confirmation of bail contingent on the findings.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances alleged.
  • Whether the removal of the deemed possession concept under the 2018 amendment precludes liability.
  • Whether the informant’s hostility affects the credibility of the FIR.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of one case under the Excise Act and

allegation is of recovery of 30 litres of liquor from house of the

Excise Act in the year 2018, the concept of deemed possession

and presumed offender has been done away with and he came to

be implicated at the instance of chowkidar with whom he is on

an inimical term. It is also submitted that if chowkidar was

aware of the involvement of the petitioner in the occurrence

then why he did not inform the police prior to institution of the

instant FIR which casts an aspersion on the case of the
