Holding
The court granted anticipatory bail to the petitioner, subject to prescribed conditions.
Summary
The petitioner, Asha Devi, was named in an FIR for allegedly kidnapping a newborn baby of the informant's daughter, who later died due to childbirth complications. The petitioner contended that the real accused is her son, Rishuraj, who had married the informant's daughter and fathered the child, and that she has a clean antecedent. She applied for anticipatory bail, which the State opposed. The court examined the allegations, noting that the primary thrust of the accusation appears against the son, and considered the petitioner’s clean record. Accordingly, the court granted anticipatory bail to the petitioner, subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 438 of the Cr.P.C. and Section 482 of the Bhartiya Nagarik Suraksha Sanhita.
Issues considered
- Whether anticipatory bail can be granted to the petitioner under Section 438 of the Cr.P.C. and Section 482 of the Bhartiya Nagarik Suraksha Sanhita despite the FIR allegations.
- Whether the allegations against the petitioner are sufficient to deny bail, given the claim that the primary culpability lies with her son.
