Holding
The court held that the anticipatory bail of the arrested petitioner is withdrawn and that bail is to be granted to the remaining petitioners as no prima facie case exists against them.
Summary
The petitioners, a group of relatives, filed an anticipatory bail application in a case where they were named in an FIR for kidnapping and alleged involvement in the rape of a 17‑year‑old informant. Petitioner No.3 (Rahul Paswan) was arrested during the pendency of his anticipatory bail petition, rendering that petition infructuous and leading to its withdrawal. The remaining petitioners argued that they had no direct role in the alleged sexual assault and were implicated only due to familial ties with the main accused, Rohit Kumar. The court examined the FIR, which invoked several sections of the Bhartiya Nyaya Sanhita, 2023 and Section 4 of the POCSO Act, and found no prima facie evidence against the petitioners. Consequently, the court dismissed the anticipatory bail for Rahul Paswan and granted bail to petitioners 1, 2, 4, 5, 6 and 7, subject to a bond of Rs 10,000 and two sureties each.
Issues considered
- The effect of arrest on an pending anticipatory bail application.
- Whether the petitioners, though named in the FIR, are entitled to bail in the absence of prima facie evidence of their participation in the alleged offences.
- Whether the allegations under the Bhartiya Nyaya Sanhita and the POCSO Act justify denial of bail to the petitioners.
