Patna High Court

Pintu KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The bail application was dismissed, and the petitioner was denied regular bail.

Summary

Petitioner Pintu Kumar applied for regular bail in a case registered under Sections 80(2) and 3(5) of the Bharatiya Nyaya Sanhita and Sections 3 and 4 of the Dowry Prohibition Act, alleging that he was falsely implicated in the dowry‑death of his wife. The prosecution alleged that the petitioner, along with other accused, killed the deceased for non‑payment of dowry. The petitioner contended that he never demanded dowry, did not torture the deceased, and that she had committed suicide; he also highlighted his clean antecedents and his custody since 4 August 2025. The State opposed bail, citing the post‑mortem report that showed multiple injuries on the deceased. The Court, considering the seriousness of the allegations and the fact that the petitioner is the husband of the deceased who died under unnatural circumstances, rejected the bail application and directed the trial court to expedite the trial within a year.
