Holding

The Court denied bail to the petitioner.

Summary

The petitioner, Ravish Kumar, was arrested in connection with a case alleging that he entered into a contract to kill a witness. He is charged under Sections 111 and 61(2) of the Bharatiya Nyaya Sanhita and Sections 25(1‑b)a, 26 and 35 of the Arms Act. The petitioner, who has two prior criminal convictions, has been in custody since 29 January 2026 and claims innocence. The State opposed his bail, emphasizing the seriousness of the alleged contract killing and his criminal record. The Court, noting that co‑accused had been granted bail but considering the petitioner a hardened criminal, declined to grant bail. The bail application was dismissed, with the Court stating that its observations are limited to this application and do not prejudice the trial.

                   APP for the State.

                                 2. The defect(s) as pointed out by the office be

                   ignored.

                                 3. The petitioner seeks bail in connection with Town

(Nagar) P.S. Case No. 40 of 2026 registered for the offence

punishable under Sections 111 and 61(2) of the Bharatiya Nyaya

                                 4. The allegation against the petitioner and other co-

accused persons is of taking a contract for killing a witness.

                                5. Learned counsel for the petitioner submits that the

petitioner is innocent and has been falsely implicated in this

                                  6. Learned APP appearing for the State opposes the

prayer for regular bail of the petitioner.

                                  7. Some of the co-accused persons have been granted

bail but since the petitioner is a hardened criminal for

committing murder having two criminal antecedents and

considering that the case is of contract killing, I am not inclined

to grant bail to the petitioner.

                                  8. Accordingly, the application stands dismissed.

                                  9. It is, however, clarified that the observations made

herein are limited to the adjudication of the present bail

application and shall not prejudice the case of the petitioner at

any subsequent stage of the trial and this Court has not express

any opinion on the merits of the case.

                                                                          (Sandeep Kumar, J)
