Patna High Court

Kunal Kumar @ Budha Kumar @ BurhwaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to a bail bond and conditions under the relevant provisions.

Summary

The petitioner Kunal Kumar was named in an FIR for alleged involvement in illegal sand mining after a police raid recovered sand and a tractor. He contended that he had no connection to the vehicle or sand and was implicated solely on the suspicion of a local chowkidar. The State and the Mines Officer opposed his anticipatory bail, arguing the seriousness of the offences under Sections 303(2), 317(2) and 111(3) of the Bhartiya Nyay Sanhita. The court observed that, apart from the chowkidar’s allegation, there was no prima facie incriminating material against the petitioner. Consequently, the court ordered that the petitioner be granted anticipatory bail, subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
