Holding
The court held that no material evidence links the petitioner to the alleged illicit wine trafficking, and procedural deficiencies exist, therefore bail was granted.
Summary
Pradip Mishra applied for bail after being implicated in a case concerning the trafficking of illicit wine, where police seized 672.58 litres of foreign liquor from a Scorpio vehicle. The petitioner asserted that he had no connection to the vehicle or the seized liquor and that the investigation lacked material linking him, citing non‑compliance with Sections 103 and 105 of the Bihar Narcotic Substances Act and the absence of videographic evidence. The State opposed bail, arguing that the petitioner was a member of the syndicate and had two prior similar convictions. The court examined the lack of substantive evidence and procedural lapses, concluding that the case rested solely on co‑accused statements. Consequently, the court ordered the petitioner’s release on bail, subject to a bond of Rs.20,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
Issues considered
- Whether there is sufficient material evidence to justify denial of bail to the petitioner.
- Whether the seizure and investigation complied with procedural requirements of the Bihar Narcotic Substances Act and the Bihar Prohibition and Excise (Amendment) Act.
- Whether Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, permits the grant of bail in the present circumstances.

the petitioner has nothing to do with the vehicle in question nor
with the illicit wine which has been recovered from the said

that the petitioner has been carrying two criminal antecedent of
identical nature, his name has been implicated in this case, but
without there being any material. There is no compliance of
Sections 103 and 105 of the BNSS as neither any independent
witness has come forward to support the seizure proceeding nor
any videography of the search and seizure has been done. Even
if the allegation is taken to be true for the sake of argument, the
materials available on record do not attract the rigors provided
under Section 76 of the Bihar Prohibition and Excise
(Amendment) Act.

behalf of the respective parties and considering the fact that no
materials have come which suggest the complicity of the
petitioner in crime, besides he has no concern with the alleged
Scorpio vehicle from which recovery has been made and the
entire case is based only upon the disclosure made by the co-
accused, let the petitioner abovenamed be released on bail, in
the event of his arrest or surrender before the court below within
