Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, subject to specified conditions.

Summary

Ujjawal Kumar was arrested in connection with the recovery of 144 litres of illicit liquor, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 read with Section 317(5) of the B.N.S, 2023. He filed an application for regular bail, claiming innocence, a clean antecedent and offering to donate Rs.25,000 to a charitable organization without admitting guilt. The State opposed the bail. The High Court, after considering the facts, allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to comply with additional conditions including a Rs.25,000 deposit to a charitable trust, monthly police‑station attendance, and verification of antecedents. The order was made subject to Section 482(2) of the B.N.S.S and clarified that the observations were prima facie and not to affect the trial. The petitioner was consequently released on bail.

Issues considered

  • Whether regular bail should be granted to the accused in an offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 read with Section 317(5) of the B.N.S, 2023, considering the seriousness of the alleged illicit liquor case and the petitioner’s claim of innocence and clean antecedent.
