The Court granted anticipatory bail to the petitioners under Section 482(2) of the Criminal Procedure Code.
Summary
The petitioners, three women from Begusarai, applied for anticipatory bail fearing arrest in a case (PS Case No.330 of 2024) involving multiple IPC offences such as criminal intimidation, assault, robbery and attempt to murder. They argued they have clean records, are falsely implicated by the informant, and that the FIR contains only vague, omnibus allegations against them. The State opposed the bail, contending the seriousness of the offences. The Court, noting the petitioners' gender, lack of prior criminal history, and the non‑specific nature of the accusations, directed that they be released on anticipatory bail upon furnishing bail bonds and sureties, subject to conditions under Section 482(2) of the Criminal Procedure Code. The application was therefore allowed.
Issues considered
- Whether anticipatory bail can be granted to the petitioners under Section 482(2) of the Criminal Procedure Code despite the serious nature of the alleged offences.
- Whether the FIR contains specific allegations against the petitioners sufficient to deny bail.
- Whether the petitioners, being women with clean antecedents, merit special consideration for bail.
