The Court granted provisional anticipatory bail to the petitioner subject to bond, sureties, and verification of her antecedent.
Summary
The petitioner, Sarswati Devi, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 30 litres of liquor from a vehicle she owned. She argued she had no conscious possession, was not arrested at the spot, and was unaware that the vehicle was misused by Md. Aarif Khan. The State opposed the bail, contending the allegations warranted detention. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties, subject to Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. The order also stipulated that the trial court verify her criminal antecedent; if any prior case is found, the bail would not be confirmed, otherwise it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail can be granted under Section 438 Cr.P.C. in a case arising under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether ownership of the vehicle used in the alleged offence suffices to implicate the petitioner.
- Whether the petitioner’s clean antecedent is a requisite condition for confirming anticipatory bail.

ORAL ORDER
2 24-06-2026 1. Heard learned counsel for the petitioner and

2. The petitioner apprehends her arrest in a case
registered for the offence punishable under Section 30(a) of the
Bihar Prohibition and Excise (Amendment) Act, 2022.
3. Learned counsel for the petitioner submits that
petitioner is a person with clean antecedent and is a woman and
allegation is of recovery of 30 litres of liquor from an auto.
4. Learned counsel for the petitioner submits that
petitioner was not arrested from the spot, as such, nothing was
recovered from her conscious possession. It is further submitted
that petitioner came to be implicated based on the fact that she is

person would use her own vehicle for committing an occurrence
and, thus, would create evidence against herself and, hence,

would get implicated. It is also submitted that petitioner was
