Holding
The court held that the lack of direct incriminating evidence and the petitioner’s prolonged custody warranted the grant of bail despite the alleged offence.
Summary
The petitioner, Anil Chaudhary, was arrested in connection with a case alleging possession of 75 litres of liquor recovered from a public place, under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was falsely implicated, no liquor was found in his personal possession, and there was no compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail, but the court considered the lack of direct incriminating evidence, the petitioner’s custody since 6 December 2025, and his criminal antecedents. Weighing these factors, the court decided to grant bail, imposing a bond of Rs 15,000 with two sureties and conditions regarding family surety and appearance in court. The order released the petitioner on bail subject to the stipulated conditions.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, precludes bail.
- Whether the absence of liquor in the accused’s personal possession justifies release on bail.
