Patna High Court

Paras SahaniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to bail as the alleged assault does not demonstrate an intention to cause death and the incident appears to be a free fight.

Summary

Paras Sahani was named in an FIR for allegedly firing at and assaulting the husband of an informant with the butt of a pistol, causing dislocated teeth. The petitioner claimed the incident stemmed from a property dispute and that the informant was hostile, arguing the alleged assault was a result of a scuffle rather than an intent to cause grievous injury. The opposing counsel contended that the assault was intentional and the injury was grievous, justifying denial of bail. The court observed that the facts suggested a "free fight" and that the use of the pistol butt did not demonstrate an intention to cause death. Consequently, the court ordered the petitioner’s release on bail, subject to a bond of Rs. 10,000 with two sureties, under Section 482(2) of the Bihar Criminal Procedure Code.

Issues considered

  • Whether the petitioner is entitled to bail in the offences alleged under Sections 126(2), 115(2), 117(2), 109, 74, 303(2), 352, 351(2) and 3(5) of the Bihar Penal Code
  • Whether the alleged assault with the butt of a pistol indicates an intention to cause grievous injury or death
  • Whether the circumstances constitute a "free fight" justifying bail
